10th Circ. Revives Sex Bias, Retaliation Suit V. United

Law360, New York (December 7, 2009, 7:50 PM EST) -- In a blow to United Airlines Inc., a federal appeals court has reinstated a lawsuit brought by a former business manager's alleging sex discrimination and retaliation by the airline.

The U.S. Court of Appeals for the Tenth Circuit ruled Monday that a lower court had wrongly concluded that plaintiff Mary Barone could not demonstrate a prima facie case under either theory of discrimination, and reversed and remanded the case for further proceedings.
