AT&T Appeals Judge's Refusal To Toss Antitrust Case

Law360, New York (December 9, 2009, 5:42 PM EST) -- AT&T Inc. has appealed a federal judge's refusal to dismiss a suit that accuses the telecommunications giant of implementing a predatory pricing program that would strip smaller carriers of their profits.

The notice of appeal to the U.S. District Court for the Fifth Circuit, lodged Tuesday in the U.S. District Court for the Northern District of Texas, challenges Judge Jorge A. Solis' Nov. 30 order refusing to throw out Budget Prepay Inc.'s antitrust case on jurisdictional and other grounds.
