Profs Tell Fed. Circ. To Make Albright Rebuke Precedential

Law360 (May 10, 2021, 6:19 PM EDT) -- Judge Alan Albright's repeated failure to rule on transfer motions in a timely manner calls for the Federal Circuit to reissue its March decision rebuking him as precedential, a group of about two dozen law professors said.

The 23 professors on Friday moved for the Federal Circuit to reissue its nonprecedential decision in In re: TracFone Wireless Inc., so that it will be binding on other courts and panels. That decision had required the Western District of Texas judge to stop focusing on the merits of the patent case until he decided whether to transfer the case out of his court....
