BofA Defeats Dismissal Bid In Noncompete Suit

Law360, New York (December 10, 2009, 5:24 PM EST) -- Finding the claims plausible, a judge has allowed Bank of America NA to proceed with a case accusing several former wealth management employees who joined UMB Financial Services Inc. of violating employment contracts by soliciting business from BofA customers.

Judge Greg Kays issued an order Wednesday in the U.S. District Court for the Western District of Missouri striking down the workers’ bid to throw out much of the complaint and finding that BofA’s claims met pleading standards under the influential Iqbal and Twombly rulings.
