Bayer Once More Defending Trasylol In Federal Court

Law360, New York (December 13, 2009, 10:31 AM EST) -- Bayer Corp. will get to defend against personal injury claims filed by 100 individual plaintiffs over the blood clotter Trasylol in federal court, now that a federal judge has denied the plaintiffs’ motion to remand the case to the state court where it was originally filed.

Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois ruled Wednesday that the sheer number of parties, combined with minimal diversity, created a “mass action” under the Class Action Fairness Act.
