Law360, New York (December 14, 2009, 3:20 PM EST) -- American Home Assurance Co. has sued a Florida developer and two of its contractors in an attempt to avoid having to pay defense and repair costs stemming from allegedly noxious Chinese drywall at a luxury condominium, arguing that the policies' pollution exclusions bar coverage.
The insurer sued Peninsula II Developers Inc., general contractor Gryphon Construction LLC and drywall contractor Skyline Systems Inc. on Friday in the U.S. District Court for the Southern District of Florida.
