Markel Had Duty To Indemnify Contractor: Texas Court

Law360, New York (December 15, 2009, 6:41 PM EST) -- The Texas Supreme Court has reversed a state appellate court's determination that Markel International Insurance Co. Ltd. did not have a duty to indemnify general contractor D.R. Horton-Texas Ltd. for work performed under a subcontractor's policy, ruling that an insurer may have a duty to indemnify its insured even when the duty to defend never arises.
