Judge Denies Request To Dismiss Patent Challenge Vs. Glaxo's AZT

Law360 (May 3, 2004, 12:00 AM EDT) -- A federal judge has refused to throw out a challenge filed by the largest AIDS group in the U.S. against GlaxoSmithKline’s patent for AZT (Retrovir), the first AIDS drug.

Late last week, the U.S. District Court for the Central District of California Western Division rejected GlaxoSmithKline's motion for summary judgment against AIDS Healthcare Foundation's (AHF) patent piracy lawsuit.

The ruling sustains AHF's federal court case over the patent for AZT and other subsequent derivative AIDS drugs, the non-profit group said in a statement.
