Shoe Companies Go Toe To Toe Over Design Patent

Law360, New York (December 17, 2009, 6:11 PM EST) -- Balenciaga Corp., the French fashion house, has kicked off a trade dress battle with Steve Madden Ltd., claiming the New York shoe designer copied its Lego shoes and sold the alleged knockoffs at a steep discount.

In a complaint lodged Tuesday in the U.S. District Court for the Eastern District of New York, Balenciaga accused Steve Madden of infringing its trademarks and copyrights by manufacturing shoes that allegedly copy the Parisian designer's “easily recognized” pumps.
