USPTO Opens Floodgates To Patent Eligibility Feedback

Law360 (July 8, 2021, 9:42 PM EDT) -- The U.S. Patent and Trademark Office wants the public to weigh in on how the state of patent eligibility law in the United States has affected various industries and technologies in order to craft a study for Congress, a request likely to draw a record number of comments.

In a Federal Register notice set to be published Friday, the USPTO asked for a wide array of stakeholders to weigh in on how court interpretations of Section 101 of the Patent Act have "impacted investment and innovation" in technologies like artificial intelligence and diagnostics over the last decade.
