9th Circ. Won't Review Denial Of Attys' Fees To Enviros

Law360, New York (December 18, 2009, 4:35 PM EST) -- A federal appeals court has rejected Citizens for Better Forestry’s bid for en banc review of an earlier decision denying attorneys’ fees to Citizens and 11 other environmental groups in their case against the U.S. Department of Agriculture over a forest management rule.

The U.S. Court of Appeals for the Ninth Circuit on Monday denied the plaintiffs’ petition for an en banc review of the court’s previous order, which blocked their request for attorneys’ fees after determining that they could not be considered prevailing parties....
