Tiberius Sues For Dissenters' Rights In Energy Merger

Law360, New York (December 21, 2009, 5:10 PM EST) -- Tiberius Capital LLC has cried foul on the merger agreement between Double Eagle Petroleum Co. and Petrosearch Energy Corp., claiming the contract deprived shareholders of the dissenters' rights required under the Securities and Exchange Act.

Tiberius, which owned nearly 15 percent of Nevada-based Petrosearch, filed the suit Friday in the U.S. District Court for the Southern District of New York, seeking $5 million in compensatory and punitive damages and an injunction requiring the defendants to provide share appraisal rights to Tiberius.
