Sterling Motion To Disallow Class Action Rejected

Law360, New York (January 5, 2010, 6:26 PM EST) -- A district judge has affirmed his earlier ruling rejecting Sterling Jewelers Inc.'s contention that an arbitrator disregarded the law by allowing female employees to pursue sex discrimination claims as a class action.

District Judge Jed S. Rakoff of the U.S. District Court for the Southern District of New York initially rejected Sterling's motion to vacate the arbitrator's ruling on Aug. 31, but held off on giving his reasons until Dec. 30, when he issued a 12-page order shooting down Sterling's claims that arbitrator Kathleen A.
