8th Circ. Backs Sioux Tribe's Treaty Right To Health Care

By Andrew Westney (August 25, 2021, 6:49 PM EDT) -- The Eighth Circuit on Wednesday upheld a South Dakota federal judge's ruling that the Rosebud Sioux Tribe is entitled to "competent physician-led health care" from the federal government, saying the government "must do better" by the tribe following severe problems at an Indian Health Service emergency room.

The government was seeking to overturn U.S. District Judge Roberto A. Lange's March 2020 order in favor of the Rosebud Sioux, while the tribe had asked the circuit court to find it was entitled to the "highest possible level" of health care under the Indian Health Care Improvement Act.
