Judge Recommends Cert. In Neb. Beef Wage Case

Law360, New York (January 5, 2010, 5:18 PM EST) -- A magistrate judge has recommended that a class be certified in litigation accusing meatpacking company Nebraska Beef Ltd. of not paying workers for time spent putting on and taking off personal protective equipment, sharpening knives, and performing other tasks.

In a finding and recommendation Monday, Magistrate Judge Thomas D. Thalken of the U.S. District Court for the District of Nebraska said the consolidated case should be certified and that the meat packer's motion to dismiss the suit should be rejected.
