Allergan Can Demand Jury In Sandoz IP Fight: Judge

Law360, New York (January 6, 2010, 2:12 PM EST) -- A federal judge has refused to strike Allergan Inc.'s demand for a jury trial in its suit accusing Novartis AG subsidiary Sandoz Inc. of patent infringement in applying to market a generic version of glaucoma treatment Combigan.

Judge John T. Ward of the U.S. District Court for the Eastern District of Texas on Tuesday denied the Novartis generics unit's bid to strike the jury demand, saying that nixing Allergan's jury demand now would be premature.
