Judge OKs Lowered Duties On Chinese Mushrooms

Law360, New York (January 6, 2010, 5:14 PM EST) -- A judge has affirmed the U.S. Department of Commerce's decision to lower anti-dumping duties on mushroom goods imported by two Chinese companies.

Judge Timothy C. Stanceu of the U.S. Court of International Trade issued an opinion Tuesday upholding Commerce's redetermination of the duties against preserved mushrooms imported by Gerber Food (Yunnan) Co. Ltd. and Green Fresh (Zhangzhou) Co. Ltd.

Judge Stanceu said in his decision that he approved Commerce's revised duties in part because the plaintiffs had not submitted comments protesting the redetermination.
