GSK Liability Suit Remanded To Ill. State Court

Law360, New York (January 7, 2010, 1:37 PM EST) -- A federal judge has sent a product liability suit against GlaxoSmithKline PLC regarding its Avandia diabetes drug back to state court, saying federal court lacks diversity jurisdiction in the case.

Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois issued the ruling Tuesday. The 99 plaintiffs in the case, who alleged they suffered injury as a result of the drug, initially filed the suit in Illinois state court, but GSK removed it to federal court.
