US Slams Hebei's Injunction Bid In Carbon Duty Fight

Law360, New York (January 7, 2010, 5:16 PM EST) -- The United States is fighting Hebei Foreign Trade and Advertising Corp.'s motion for a preliminary injunction, saying the Chinese activated carbon exporter's challenge to the U.S. Department of Commerce’s decision on its anti-dumping rate is unlikely to succeed on its merits.

The U.S. — which said it usually does not seek to prevent preliminary injunctions in these types of cases — requested that the court deny Hebei's motion in a response filed in the U.S. Court of International Trade on Tuesday.
