Insurer Hit With Private Atty General OT Suit

Law360, New York (January 12, 2010, 1:25 PM EST) -- Insurance Company of the West is facing a private attorney general suit brought by a former employee who claims the insurer failed to compensate its technology workers for overtime and meal breaks or to keep proper pay records.

Tobin Hill lodged a complaint on Monday in the U.S. District Court for the Southern District of California, alleging the San Diego-based insurance company breached the California Labor Code and the Fair Labor Standards Act.

He is seeking more than $400,000 in civil penalties for the alleged violations....
