AT&T Call Center Workers Win Cert. In OT Suit

Law360, New York (January 13, 2010, 5:13 PM EST) -- A group of AT&T call center workers has won conditional certification for their collective action against the phone giant seeking overtime compensation for the time it takes them to log into their systems prior to shifts.

Judge Ortrie D. Smith conditionally granted the employees’ request for national class certification in the U.S. District Court for the Western District of Missouri on Tuesday. The plaintiffs have easily met the burden imposed on them at this stage of the litigation, he ruled.
