Tech Giants Weigh In On 337 Requirement

Law360, New York (January 14, 2010, 4:20 PM EST) -- Nearly a dozen technology companies — including Google Inc., Dell Inc. and Samsung Electronics Co. Ltd. — have argued to the U.S. International Trade Commission that a firm's history of litigating intellectual property licenses is not enough to entitle it to Section 337 relief.

The companies told the ITC in submissions Wednesday that spending money on litigation did not satisfy the requirement under Section 337 of the Tariff Act that a firm must make a "substantial investment" in the exploitation of a technology in the U.S....
