NJ High Court OKs Post-Firing Retaliation Claim

Law360, New York (January 15, 2010, 6:01 PM EST) -- The New Jersey Supreme Court has found that a former employee of a Hispanic food products distributer had grounds to sue over alleged discriminatory conduct that took place after he was fired.

In a unanimous decision Thursday, the New Jersey high court ruled Fernando Roa's claim that the cancellation of his insurance benefits after his termination constituted an independently actionable retaliation claim under New Jersey's Law Against Discrimination.
