GameStop FLSA Case Should Be Arbitrated: Judge

Law360, New York (January 15, 2010, 2:30 PM EST) -- A judge has dismissed a proposed Fair Labor Standards Act collective action brought against video game retailer GameStop Inc., saying an arbitration agreement the plaintiff signed is binding.

On Thursday Judge Vanessa L. Bryant of the U.S. District Court for the District of Connecticut entered judgment in the case filed by former store manager Justin Pomposi. In an opinion filed earlier in the week the judge said GameStop's arbitration program is not unconscionable, as Pomposi had argued.
