Magistrate Recommends Stay In Pharmaceutical Case

Law360, New York (December 1, 2006, 12:00 AM EST) -- A federal magistrate judge said Thursday that she is inclined to grant an injunction to a group of small pharmaceutical wholesalers that would stay a provision of a drug law that would force distributors to keep a record of everyone that has handled a drug.

Nine "secondary wholesalers"—sellers who don’t buy pharmaceuticals directly from manufacturers—are seeking a preliminary injunction enjoining the Department of Health and Human Services and the U.S. Food and Drug Administration rule from becoming effective.
