DOJ Slaps J&J Over Millions In Kickbacks To Omnicare

Law360, New York (January 15, 2010, 1:03 PM EST) -- The U.S. government filed a complaint Friday accusing Johnson & Johnson of paying tens of millions in kickbacks to induce long-term care pharmacy Omnicare Inc. to recommend the pharmaceutical giant's drugs, including the antipsychotic Risperdal, to nursing homes.

Intervening in two pending consolidated whistleblower suits, the government filed its complaint in the U.S. District Court for the District of Massachusetts claiming that the pharmaceutical company violated the False Claims Act because the alleged kickbacks caused Omnicare to submit false claims to Medicaid.
