Medical Cos. Get OK For Long Brief In Gene Patent Spat

Law360, New York (January 19, 2010, 4:21 PM EST) -- An amicus brief from a group of diagnostic medicine companies and trade associations in the Myriad Genetics Inc. gene patenting case is one step closer to being accepted, now that a federal court has granted the authors' motion to surpass length limits.

The 44-page brief, lodged Jan. 6 in the U.S. District Court for the Southern District of New York, urges the court to block plaintiffs' attempts to “undermine” a patent system that has “served this country well” by upholding the constitutionality of gene patenting....
