High Court Mulls Deference In ERISA Suits

Law360, New York (January 20, 2010, 7:34 PM EST) -- The U.S. Supreme Court grappled Wednesday with an epic benefits dispute that has eroded the authority of retirement plan administrators to interpret contested benefits under the Employee Retirement Income Security Act.

During oral arguments, the high court contemplated a retirement plan administrator’s claim that an appeals court blundered when it failed to defer to the administrator in a long-running dispute over calculated benefits for rehired Xerox Corp. employees and deferred instead to the district court’s interpretation of the plan.
