Dell Appeals Nixed In Canadian Laptop Class Action

Law360, New York (January 26, 2010, 3:58 PM EST) -- Dell Canada Inc. has lost a bid to overturn two Canadian court rulings that stifled its attempt to force consumers to arbitrate claims over defective computers in favor of allowing them to pursue the case as a class action.

A five-judge panel of the Court of Appeal for Ontario issued a ruling Jan. 20 upholding both the lower court's refusal in February 2009 to stay the case in favor of arbitration and a later ruling refusing to reconsider its decision.
