J&J Unit Wins Bid To Nix Tylenol Product Liability Suit

Law360, New York (January 25, 2010, 6:43 PM EST) -- Relying heavily on a standard that determines the admissibility of scientific evidence in court, a New York judge has granted Johnson & Johnson unit McNeil-PPC Inc.'s bid to toss a consumer suit claiming that Tylenol caused her to develop cirrhosis of the liver.

Judge Leon Ruchelsman of the Supreme Court of the State of New York, Kings County, on Jan. 19 agreed with McNeil's contention that there was no scientifically acceptable evidence linking cirrhosis and Tylenol's main component acetaminophen, ruling that the plaintiff's expert testimony failed...
