Flonase Antitrust Suit Withstands GSK Dismissal Bid

Law360, New York (January 27, 2010, 3:27 PM EST) -- A federal judge has denied GlaxoSmithKline Inc.'s bid to toss an antitrust suit brought by Boehringer Ingelheim Corp. subsidiary Roxane Laboratories Inc. accusing GSK of filing sham citizen petitions with U.S. regulators in order to delay approval of a generic version of Flonase nasal spray.

Judge Anita B. Brody of the U.S. District Court for the Eastern District of Pennsylvania issued a memorandum and order Tuesday denying GSK's July 23 motion to dismiss Roxane's amended complaint, rejecting the defendant's claim that Roxane lacked antitrust standing....
