1st Circ. Restores Artist's Rights Suit Against Museum

Law360, New York (January 28, 2010, 2:23 PM EST) -- A federal appeals court has revived a Swiss artist's suit against the Massachusetts Museum of Contemporary Art that alleged the museum breached the Copyright Act and violated the plaintiff's right to artistic integrity when it attempted to display his huge, but incomplete, installation.

The U.S. Court of Appeals for the First Circuit on Wednesday overturned a 2008 summary judgment ruling in favor of the museum, finding that triable issues were presented by artist Christoph Buchel.
