Judge Upholds Dumping Margins For Thai Shrimp

Law360, New York (January 28, 2010, 5:45 PM EST) -- In a setback for the domestic shrimp industry, a federal judge has upheld the U.S. Department of Commerce's lowered dumping margins for certain warmwater shrimp imported from Thailand.

Judge Evan J. Wallach of the U.S. Court of International Trade ruled that the Commerce Department had lawfully selected four mandatory respondents by largest volume when calculating dumping margins for the period between Feb. 1, 2006, and Jan. 31, 2007; that it properly treated warehousing expenses as moving expenses; and that it properly declined to apply the adverse...
