U.S. District Court Judge OKs Eminem Copyright Suit Vs. Apple, Viacom, TBWA

Law360 (May 18, 2004, 12:00 AM EDT) -- A U.S. District Court Judge has allowed rapper Eminem's copyright infringement claims over use of his song "Lose Yourself" in a commercial for Apple Computer to go forward.

Anna Diggs Taylor, Chief Judge of the U.S. District Court for the Eastern District of Michigan in Detroit, ruled Monday that the suit brought by Eminem's publishing company can proceed against several companies, including MTV parent company Viacom and advertising agency TBWA/Chiat/Day.

However, she dismissed two state law-based claims of unfair competition and unjust enrichment.
