Federal Circuit Upholds Ban On Generic Plavix

Law360 (December 8, 2006, 12:00 AM EST) -- In a victory for Sanofi-Aventis, the U.S. Court of Appeals for the Federal Circuit on Friday denied a request by Apotex to lift an injunction barring the Canadian drug maker from selling a generic version of the blockbuster blood-thinner Plavix.

Calling Apotex Inc.’s arguments “unpersuasive,” the court agreed with U.S. District Judge Sidney Stein in Manhattan in his determination that Apotex had failed to raise substantial questions about whether the patents at issue were valid or enforceable.
