Feds Fight ESA, NEPA Claims In 3-State Water Wars

Law360, New York (February 11, 2010, 3:11 PM EST) -- The federal government has fired off a bid to snuff out the second phase of an epic water rights battle involving Alabama, Georgia and Florida, saying it has done the “hard work” required by federal law to protect imperiled species in the states' waters.

In the U.S. District Court for the Middle District of Florida on Wednesday, the U.S. Army Corps of Engineers and the U.S. Fish and Wildlife Service filed a 154-page motion for summary judgment on the “phase two” claims in the multidistrict litigation....
