Class Cert. Denied In Auto Credit Insurance Repay Suit

Law360 (February 11, 2010, 6:43 PM EST) -- A federal judge has denied class certification on a breach of contract claim filed by an Ohio woman who claims Cardif Life Insurance Co. failed to refund unearned credit insurance premiums paid by car buyers to the Florida-based insurer.

Judge Patricia A. Gaughan's order, issued Tuesday in the U.S. District Court for the Northern District of Ohio, said that plaintiff Amanda K. Eldridge failed to show that the putative class is so numerous as to make joinder impracticable.
