Judge Sends ClearValue Suit Back To State Court

Law360, New York (February 11, 2010, 4:42 PM EST) -- A federal judge has sent back to state court a lawsuit by ClearValue Inc. CEO Richard Haase that accuses the defendants in a 2005 patent infringement suit of conspiracy and fraud for their role in winning discovery sanctions against the water purification company.

In an opinion issued Tuesday, Judge Leonard Davis of the U.S. District of Court for the Eastern District of Texas said the suit did not raise a federal question of patent infringement that would justify keeping it in federal court.
