9th Circ. Remands Neuralstem Stem Cell IP Suit

Law360, New York (February 11, 2010, 5:53 PM EST) -- A federal appeals court has reversed a lower court's ruling that a trade secrets battle brought by Neuralstem Inc. against rival ReNeuron Ltd. over stem cell technology should be litigated in England, sending the case back to California.

The U.S. Court of Appeals for the Ninth Circuit on Thursday found that the lower court abused its discretion in weighing the public and private interest factors when it determined that England would be a better forum for the case.
