H&R Block Tax Agents' OT Action Conditionally Certified

Law360, New York (February 12, 2010, 1:35 PM EST) -- Following the plaintiffs’ reconsideration bid, a judge has opted to conditionally certify a class of former tax agents who allege H&R Block failed to pay them overtime wages.

Judge James Lawrence King granted the motion for conditional class certification on Thursday in the U.S. District Court for the Southern District of Florida, finding that the plaintiffs’ newly restricted class definition allowed it to meet the burden for the first hurdle of class certification.
