Texas Court Won't Rehear Electricity Contract Spat

Law360, New York (February 17, 2010, 6:05 PM EST) -- After affirming a lower court's decision to toss the case, a Texas state appeals court has refused to rehear a breach of contract dispute over an electricity-brokering agreement between Texas Energy Innovation Inc. and Hino Electric Power Co. Inc.

In its decision Friday, the Texas Court of Appeals, Third District, substituted a new decision in place of its December finding and rebuffed TEI's request for a rehearing. The new decision comes to the same result as the December decision.
