Insurer Wants Out Of Defense For Gas Explosion Suit

Law360, New York (February 18, 2010, 1:16 PM EST) -- Bituminous Casualty Co. has asked a federal court to declare that a pollution exclusion in its insurance policies dictates that it has no duty to defend a construction company in a lawsuit stemming from an explosion caused by a gas leak.

The insurer filed its declaratory judgment suit Wednesday in the U.S. District Court for the Eastern District of Texas, seeking an order that it is not obligated to fund Dickerson Construction Co. Inc.'s defense in a suit seeking to hold it liable for the explosion....
