Altana Files Patent Suit Vs. Teva Over Anti-Ulcer Drug

Law360, New York (May 25, 2004, 12:00 AM EDT) -- German drugmaker Altana AG and marketing partner Wyeth have sued Israeli generics maker Teva for patent infringement of its anti-ulcer drug, pantoprazole.

The lawsuit was filed in the U.S. District Court for the District of New Jersey, in response to an Abbreviated New Drug Application (ANDA) filed with the U.S. Food and Drug Administration under paragraph IV certification, the companies said.

Two other generics makers, including Sandoz, the generics unit of Swiss drugmaker Novartis, have also filed ANDAs for pantoprazole. Altana and Wyeth said they are...
