TVA Worker's OT Suit Gets Conditional Collective Cert.

Law360, New York (February 24, 2010, 3:13 PM EST) -- A federal judge has conditionally certified a Fair Labor Standards Act collective action alleging the Tennessee Valley Authority failed to compensate employees for time spent traveling, but he rejected the plaintiff's bid for the class period to span a decade.

In an order Monday, Judge Thomas B. Russell of the U.S. District Court for the Western District of Kentucky also rebuffed utility provider the Tennessee Valley Authority's bid for summary judgment in the case brought by former employee Douglas Bassett.
