ArcelorMittal Loses Carbon Emissions Fight In EU Court

Law360, New York (March 2, 2010, 3:30 PM EST) -- A European Union court dismissed on Tuesday ArcelorMittal's

challenge to the 2005 Emissions Trading Directive, ruling that the steel behemoth hasn't shown that it is unfairly affected by the directive.

The General Court of the European Union deemed Arcelor's challenge to the directive inadmissible because the directive's provisions don't apply to the steel giant "directly and individually." Moreover, the court rejected its argument that the directive's exemptions of certain industries from its scope violate the principle of equal treatment.
