Ortho-McNeil Sues Barr Over Topamax Generic

Law360, New York (December 18, 2006, 12:00 AM EST) -- A Johnson & Johnson subsidiary has filed a lawsuit against Barr Laboratories Inc. over the company’s move to offer a generic equivalent of lucrative epilepsy and migraine drug Topamax.

Ortho-McNeil Pharmaceutical Inc. alleges in a lawsuit filed Friday in the U.S. District Court for the District of New Jersey that Barr filed an Abbreviated New Drug Application to sell and market the drug before Ortho-McNeil’s patent protection ends in 2008.
