Cardone HR Execs To Remain In FMLA Retaliation Suit

Law360, New York (March 2, 2010, 7:31 PM EST) -- A judge has refused to dismiss claims that several human resources officials at auto parts maker Cardone Industries Inc. ran afoul federal law by firing a longtime tool designer who sought medical leave and short-term disability pay while he underwent leg surgery.

Judge Thomas N. O’Neill Jr. of the U.S. District Court for the Eastern District of Pennsylvania ruled Feb. 24 that the Cardone executives had not shown that Dmitry Narodetsky's complaint under the Family and Medical Leave Act and the Employee Retirement Income Security Act...
