US Shrimpers Lose Appeal Of Thai Shrimp Duties

Law360, New York (March 2, 2010, 7:36 PM EST) -- A federal appeals court has denied a group of domestic shrimpers' bid to contest a U.S. Department of Commerce determination on the dumping margin for certain frozen warmwater shrimp from Thailand.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit ruled 2-1 Tuesday that the U.S. Court of International Trade properly approved Commerce's decision not to apply the so-called multinational corporation provision in its assessment of Thai I-Mei Foods Co. Ltd., on which it recommended a dumping margin of 2.58 percent....
