Stay Lifted In Microsoft Data Encryption Patent Case

Law360, New York (March 4, 2010, 2:11 PM EST) -- A federal judge has allowed a New York inventor to proceed with an infringement case against Microsoft Corp. over data encryption technology, following the U.S. Patent and Trademark Office's affirmation of the asserted patent on re-examination.

Senior Judge Arthur D. Spatt of the U.S. District Court for the Eastern District of New York on Wednesday granted inventor Luciano F. Paone’s bid to lift a stay in the case following a third re-exam of U.S. Patent Number 6,259,789 that confirmed all of the claims-at-issue.
