Denny's Settles Royalties Dispute With Franchisee

Law360, New York (March 4, 2010, 3:55 PM EST) -- Denny's Inc. has reached an accord with a former franchisee in a trademark infringement suit over royalty fees, laying to rest a bitter dispute that included counterclaims that the restaurant chain's termination of the franchisee's contract was partially motivated by race.

The settlement, approved Wednesday by Judge Susan R. Bolton in the U.S. District Court for the District of Arizona, comes after the parties agreed to dismiss the case “in its entirety and with prejudice,” according to a stipulation and joint motion related to the deal....
